Summary

Our nationally recognised Recoveries Department seek a Solicitor to join our Insolvency Litigation team based in Beverley, East Yorkshire.

This is an exciting opportunity to join a team undertaking a variety of Personal and Corporate Insolvency Litigation generated by Wilkin Chapman’s unique law Firm/Insolvency Practitioner model as well as carrying out litigation for Insolvency Practitioner clients.

The Role

The sucessful candidate will contribute to the achievement of the department's goals and objectives and maximize departmental profitability.

The role will involve supporting the Firm’s Insolvency Practitioners, Partners and other Solicitors in providing Insolvency Litigation advice to the Firm's clients including our own Insolvency Practitioners or those employed by Wilkin Chapman Business Solutions Ltd as well as external Insolvency Practitioners and a range of clients requiring insolvency advice. Handling a broad range of quality personal and corporate insolvency litigation.

Duties will include

Personal Insolvency Litigation

  • Dealing with applications for possession and sale, applications to suspend discharge, applications for disclosure (s366), antecedent transaction applications such as preferences and transactions at undervalue.
  • Dealing with annulment of bankruptcy applications, applications to set aside statutory demands and disputed bankruptcy petitions.

Corporate Insolvency Litigation

  • Dealing with claims against Directors including recovery of Director Loan Accounts, recovery of Unlawful Dividends and misfeasance applications.
  • Dealing with applications to rescind winding up orders, applications for validation orders, injunctions to prevent presentation of a petition or restrain advertisement of winding up petition and advising on disputed winding up petitions. 
  • Dealing with antecedent transactions including voidable transactions, preferences, transactions at undervalue and transactions to defraud creditors.
  • Providing insolvency litigation support to the Insolvency Practitioners at Wilkin Chapman LLP and Wilkin Chapman Business Solutions Ltd as well as other Departments around the business.
  • Assisting in training initiatives where required.
  • Contributing to and initiating business development events in line with the Recoveries Department business plan.
  • Ensuring that all matters are conducted in the client's best interests and in accordance with the highest professional standards and applicable "quality" standards at all times.
  • Maintaining files so that they are clear and well organised and ensuring that each file is reviewed on a regular basis and by reference to the monthly matters list produced by the Accounts team.
  • Maintaining time recording on client matters on a daily basis.
  • Regularly updating clients as to the current situation of their case.
  • Dealing with routine and difficult enquiries from telephone callers and clients effectively and efficiently and ensuring that all client complaints are dealt with both professionally and promptly to the complete satisfaction of the client.
  • A good understanding of the obligations relating to client accounts and ensuring that the preparation and service of bills comply with the Solicitors Accounts Rules.
  • Achieving the annual financial targets set by the Head of Department/Divisional Head.
  • Keeping up to date with case law.
  • Ensuring compliance with Law Society Training Regulations.
Qualifications
  • Whilst some Insolvency Litigation experience would be advantageous the position may suit a variety of candidates from Legal Executives or newly qualified Solicitors, to Solicitors with Litigation experience looking to specialise in a new area through to experienced Insolvency Lawyers looking for a new challenge.
  • Full training will be provided to candidates with limited insolvency knowledge.
  • Salary negotiable and dependent on experience.
